MyndVerse™ and Aikattva Foundation™ are registered trademarks protected under the Trade Marks Act, 1999, as amended from time to time. Copyright in original protected works is governed principally by the Copyright Act, 1957 and the Copyright Rules, 2013, as amended from time to time. 1. INTELLECTUAL PROPERTY RIGHTS
For the purposes of this Policy, “Intellectual Property Rights” or “IPR” includes rights recognised under applicable Indian law relating to copyright, trademarks, patents, designs, geographical indications and other intellectual-property rights.
Different categories of intellectual property are governed by different laws and legal procedures. Accordingly, a complaint concerning copyright may be dealt with differently from a complaint concerning a trademark, patent, design or other intellectual-property right.
2. MYNDVERSE™ AND AIKATTVA FOUNDATION™ TRADEMARKS
MyndVerse™ and Aikattva Foundation™ are registered trademarks.
Their names, logos, marks, branding, designs and associated proprietary materials may not be copied, reproduced, modified, commercially exploited or used in a manner that falsely suggests affiliation, sponsorship, endorsement or authorisation without prior written permission, except where otherwise permitted by applicable law.
Unauthorised or misleading use may result in appropriate action under the Trade Marks Act, 1999, applicable law and/or MyndVerse’s Terms of Use.
3. USER-GENERATED CONTENT
MyndVerse allows users and members to upload, publish, share and otherwise contribute content, including photographs, videos, text, articles, graphics, artwork, audio, links and other materials.
Each user is responsible for ensuring that content uploaded, published, shared or otherwise made available by them does not infringe the copyright, trademark, patent, design, privacy, publicity or other legal or proprietary rights of any third party.
Users must upload or publish content only where they:
• own the relevant rights;
• have obtained the necessary licence or permission;
• are otherwise legally authorised to use the content; or
• have a lawful basis for the use, including where an applicable statutory exception or limitation applies.
Users must not knowingly upload or publish content that is unlawful or infringes the intellectual-property rights of another person.
4. COPYRIGHT
Copyright in original literary, artistic, musical, dramatic, photographic, cinematographic and other protected works is governed principally by the Copyright Act, 1957 and the Copyright Rules, 2013, as amended from time to time.
Examples of potentially protected works include:
• photographs;
• videos;
• music and sound recordings;
• articles and written material;
• books and literary works;
• artwork and illustrations;
• films and audiovisual works;
• graphics and designs; and
• other original creative works protected under applicable law.
Users must not upload or publish copyrighted material belonging to another person without appropriate authorisation, licence or other lawful basis.
5. TRADEMARKS AND OTHER INTELLECTUAL PROPERTY
MyndVerse respects registered and unregistered trademarks, service marks, trade names, logos, patents, designs and other intellectual-property rights.
If a person believes that content published on MyndVerse infringes such rights, they may submit a complaint in accordance with this Policy.
The copyright-specific procedures under the Copyright Act and Copyright Rules do not automatically apply to every other category of intellectual property. Complaints relating to trademarks, patents, designs or other rights will be considered under the applicable law and circumstances of the complaint.

7. COPYRIGHT-SPECIFIC TAKEDOWN PROCEDURE
Copyright complaints may be handled in accordance with the Copyright Act, 1957 and Copyright Rules, 2013, including Rule 75 where applicable.
Rule 75 concerns certain circumstances involving transient or incidental storage under the Copyright Act and contains specific requirements concerning identification of the work, ownership or exclusive rights, the allegedly infringing copy, its location and related legal proceedings.
Accordingly, Rule 75 should not be treated as a universal 21-day takedown rule applicable to every copyright, trademark or intellectual-property complaint.
Where Rule 75 applies, MyndVerse may follow the procedure prescribed by law, including the requirements concerning proceedings before a competent court and production of an appropriate court order.
8. REVIEW OF COMPLAINTS

You should provide:
• the URL or location of the affected content;
• an explanation of your right or authority to publish the content;

MyndVerse may review the information provided and take appropriate action in accordance with applicable law.
10. USER RESPONSIBILITY AND LIABILITY
A user remains responsible for content independently uploaded, published, shared or otherwise made available by that user.
MyndVerse™ and Aikattva Foundation™ do not assume responsibility for the underlying infringement committed solely by a user through user-uploaded content, to the extent permitted by applicable law.
Where applicable, MyndVerse will comply with the legal obligations applicable to its activities, including relevant intermediary due-diligence, grievance redressal and lawful content-removal requirements.
Nothing in this Policy shall be interpreted as:
• authorising unlawful content;
• transferring responsibility for a user’s own unlawful acts to MyndVerse or Aikattva Foundation;
• excluding any liability that cannot legally be excluded; or
• limiting any statutory right or remedy available under Indian law.
11. REPEAT INFRINGEMENT
Where a user repeatedly uploads, publishes or shares content that infringes third-party intellectual-property rights, MyndVerse may, subject to applicable law and its Terms of Use:
• remove or restrict the relevant content;
• issue a warning;
• restrict account functionality;
• suspend the account; or
• terminate the account or access to the platform.
The action taken may depend upon the nature, seriousness and frequency of the violations.
12. FALSE OR BAD-FAITH COMPLAINTS
Intellectual-property complaints must not knowingly contain false, misleading or materially incomplete information.
A person submitting a complaint must have a genuine legal or proprietary interest in the right being asserted or be properly authorised to act on behalf of the rights-holder.
MyndVerse may take appropriate action in response to misuse of the reporting mechanism, subject to applicable law.
13. NO DETERMINATION OF COMPLEX LEGAL RIGHTS
MyndVerse may review and act upon complaints based on the information reasonably available to it.
However, MyndVerse is not a court of law and may not be able to conclusively determine complex questions concerning ownership, title, infringement, validity, fair dealing, statutory exceptions or competing legal rights.
Where appropriate, the parties may be required to obtain determination or directions from a competent court or other legally authorised authority.
14. NO WAIVER OF LEGAL RIGHTS
Nothing in this Policy prevents any copyright owner, trademark owner, user or other affected person from exercising rights or remedies available under applicable Indian law.
Nothing in this Policy shall be construed as a waiver of any statutory protection, defence, exemption or remedy available to MyndVerse, Aikattva Foundation, users, rights-holders or any other person under applicable law.
15. GOVERNING LAW
This Policy shall be governed by and interpreted in accordance with the laws of India.
All matters relating to intellectual-property rights, content complaints and takedown requests shall be dealt with in accordance with applicable Indian law.
